Remember the jukebox? A quarter for one song. Now? 148 plays of "A Songwriter's Prayer" earned $0.13 from ASCAP. Not even a tenth of a penny per play. The streaming model is fundamentally broken.

ASCAP cannot listen to every radio station 24/7. So they listen to a few stations for a few hours (a "sample") and use math to guess what was played everywhere else.
The Modern Reality: Census
With digital fingerprinting (like Shazam technology) and logs, it is technically possible to track 100% of plays rather than guessing.
The Flaw That Hurts Indie Artists
If my song plays on a local station in Pompano Beach on a Tuesday at 2 AM, and ASCAP wasn't listening at that exact moment, I get paid $0. It's a lottery system.
Continuing to use "Sampling" for radio in 2026 disproportionately hurts independent artists who get sporadic airplay, while major label artists (who get played every hour) are guaranteed to be caught in the sample.
The Legal Foundation
The Consent Decree: Second Amended Final Judgment (AFJ2)

The Obligation (Section VII): ASCAP must distribute royalties collected in a manner that is "fair and non-discriminatory" among its members.

People ask how a "tough guy" activist ends up raising a baby squirrel. The answer is simple: I fight for the underdog.

During Covid, we rescued Sparky, a newborn squirrel other squirrels had rejected. Like all newborn squirrels, she was born with her eyes closed β we originally thought she was a "he" based on a little tuft that turned out to be nothing!
We raised her, then acclimated her back to the wild. She came back to us to have her babies and share them with us. Those babies were also released, and now we're surrounded by a thriving squirrel community.
